PROMOTION TERMS & CONDITIONS

YOUR USE OF:

  • OR THE PURCHASE OF A MEMBERSHIP, 

CONSTITUTES YOUR AGREEMENT TO THESE TERMS AND CONDITIONS AND YOUR BINDING ACCEPTANCE OF THEM, INCLUDING ANY AMENDMENTS THAT LOGAN PERKS MAKES FROM TIME TO TIME.

Any such amendments will be listed on our website, and notified to our members by email. 

You understand that Logan Perks may discontinue or restrict your use of the Site and/or the Service for any reason at its absolute discretion upon notice being given to you by email. 

ELIGIBLE ENTRANTS

Entry to the Promotion is solely open to:

  • Logan City, QLD residents aged 18 years or over.

ENTRY REQUIREMENTS & INSTRUCTIONS

To enter the Promotion, you must:

1. Visit the Logan Perks Website;

2. Purchase access to Logan Perks’ dashboard on the Website,

DRAW DATE & METHOD

- There will be a total of one winner determined for each Prize in respect of this Promotion (“Winner”).

- The Prize draw to determine the Winner will take place at a time and place to be determined by the Promoter (“Draw”) at its absolute discretion, via a government-approved digital draw system in the presence of an independent scrutineer.

NOTIFICATION OF THE WINNER

- The Winner will be published on the Promoter’s website for a minimum of 28 days.

- The Promoter will notify prize winners by phone and email within 48 hours of the draw.

Redraw

- If the winner has not claimed their prize within 1 week (168 hours), a re-draw will occur to enable a new winner.

 GENERAL TERMS & CONDITIONS

1. Introduction & The Promotion

1.1 These Terms & Conditions are to be read in conjunction with the Promotion Details above. Any capitalised terms used in these Terms & Conditions have the meaning set out in the Promotion Details above.

1.2 By participating in the Promotion, you agree to be bound by these Terms & Conditions, which constitute a legally binding agreement between you and the Promoter.

1.3 All decisions made by the Promoter with respect to any aspect of the Promotion are at its absolute discretion, and no correspondence will be entered into with you.

ENTRY

2.1 All entries in the Promotion must comply with these Terms & Conditions (“Entry”) and each Entry has an equal chance at winning the Prize.

2.2 Your Entry must be submitted:

  1. During the Promotional Period stated in the Promotion Details;

  2. According to the Entry Requirements & Instructions stated in the Promotion Terms & Conditions; and

  3. According to the Entry Conditions stated in the Promotion Terms & Conditions.

2.3 Your Entry will be deemed to be received only when the Promoter confirms receipt of a new membership by you

2.4 If you submit an Entry, you warrant that you are an Eligible Entrant. You may be otherwise disqualified from the Promotion. The Promoter reserves all rights with respect to such breach at its absolute discretion. SA, NSW and ACT are excluded from trade promotions due to permit restrictions.

2.5 You are solely responsible for your Entry, including any costs associated with entering the Promotion and/or network connectivity.

2.6 Where applicable, except for your personal information, the Promoter is the sole owner of all intellectual property in connection with the Promotion (including your Entry).

 DRAW & RESERVE WINNERS

4.1 The Promoter will conduct the Prize Draw and the Winner shall be selected at random.

4.2 The Winner will be notified according to the Promotion Terms and Conditions.

4.3 The Promoter may draw additional reserve Entry Winners in the Draw and record them in order (“Reserve Winner”).

4.4 In the event that:
1. a Winner is deemed ineligible for any reason;
2. after the Promoter makes reasonable efforts, the Winner cannot be identified; or
3. where a Winner forfeits a Prize. 

PARTICIPANT CONDUCT & BREACH

5.1 You must not:
1. tamper with the Promotion in any way or at any stage;
2. engage in any conduct that may jeopardise the fair and proper conduct of the Promotion;
3. act in a disruptive, annoying, threatening, abusive or harassing manner; or
4. do anything that may diminish the good name or reputation of the Promoter or any of its related partners, suppliers, entities and/or of the agencies or companies associated with this Promotion.

5.2 The Promoter reserves the right, at any time, to require documentation from you to verify the validity of your Entry.

PERSONAL INFORMATION AND PROMOTIONS & MEDIA

6.1 The Promoter will collect your personal information in connection with the Promotion to:
a. Conduct the Promotion;
b. Provide you with the Promoter’s monthly subscription updates; and
c. Market the Promoter and its services.

6.2 The Winner agrees to participate in promotional activity and consents to the use of the Winner’s name and image in connection with the Promotion.

DEFINITIONS

In these Terms and Conditions, unless the context otherwise requires:

“Promoter” means Harkoss Pty Ltd, trading as Logan Perks (ACN 689 720 661).

“Customer” means the person(s) (including a body corporate) who orders the Products from the Promoter (and includes any person acting on behalf of, and with the written authorisation of, the Customer);

“Price” means the price payable by the Customer to the Promoter for the Products;

“Products” means goods or services supplied by the Promoter to the Customer (and where the context so permits shall include any supply of services such as the provision of advice or recommendations) and are as described on the invoices, quotation, work authorisation or any other forms provided by the Promoter to the Customer;

“Terms and Conditions” means the terms and conditions stated in this document.

PAYMENT

All prices listed on this site are in Australian dollars and are subject to change without notice. The Promoter reserves the right to make changes to prices, products, product availability, policies and terms at any given time. The Promoter accepts the following payment methods: Credit/Debit Card and PayPal. All payments options are securely processed via the respective third-parties: PayPal for credit and debit cards and PayPal for PayPal payments. For Credit/Debit card payments, the Promoter accepts Visa and MasterCard only.

INTELLECTUAL PROPERTY

All content, information, graphics and website design are the property of the Promoter and are not to be used or reproduced without the consent of the Promoter.

RETURNS/REFUNDS

The Promoter reserves the right, at its absolute discretion, to accept any cancellation of the Customer's membership package. To be considered for a refund or member cancellation, the Customer must request it by email to the Promoter. The Promoter will notify the Customer of the outcome of the request and refund any funds if applicable. 

Membership Subscriptions: Membership fees are generally non-refundable. However, if you believe you have been incorrectly charged or there are exceptional circumstances, you may request a refund by contacting our support team. Requests will be assessed on a case-by-case basis in compliance with Australian Consumer Law.

Processing Refund Requests: If a refund is approved, the amount will be processed back to the original payment method within a reasonable timeframe. Processing times may vary depending on your financial institution, but allow between 5-7 business days for the refund to be processed.

You may be entitled to a remedy if the service:

  • is not supplied with due care and skill,

  • is not fit for the purpose we advertise, or

  • is not delivered as described.

Major failure If a digital service has a major failure, you are entitled to:

  • cancel your Logan Perks contract; and

  • receive a refund for the unused portion of your service; or

  • receive compensation for any reduction in value.

Minor failure If the issue is minor, Logan Perks will rectify the problem within a reasonable time. If we do not do so, you may:

  • cancel the service and obtain a refund for the unused portion; or

  • seek a price reduction.

Situations Not Eligible for Refund You are not entitled to a refund, cancellation, or compensation if:

  • You changed your mind,

  • You did not read, or understand, these terms and conditions

  • You misunderstood the membership features despite accurate and clear information being provided,

  • You did not use the service,

  • You purchased the wrong membership tier by mistake but the service was delivered as described,

  • You did not read or follow instructions on how to access or use your digital benefits,

  • You experienced issues caused by your own internet connection, device, or account settings.

USE OF ACCOUNT

In creating an Account, you shall not 

a. select or use the email address or username of another person with the intent to impersonate that person, or otherwise,

b. use a name subject to another person’s rights without their authorization, 

c. use an email address or username that is profane, offensive, or otherwise inappropriate or 

d. allow any other party to use your Account or password except as set forth herein.

You may not share or transfer any Account. 

You may not disclose your password to anyone. 

You agree to immediately notify Logan Perks by sending an email to david@loganperks.com.au of any known or suspected unauthorized use(s) of your Account or any known or suspected breach of security, including loss, theft or unauthorized disclosure of your password. 

You understand and agree that you shall be liable for all activities that occur under any Account created for your use, even if such activities were not committed by you. Logan Perks is not responsible for any loss or damage arising from your failure to maintain the confidentiality of your password.

The Site may contain links to websites operated by other third parties.

JURISDICTION

These Terms and Conditions shall be governed by the laws of Queensland. The Promoter and the Customer irrevocably submit to the exclusive jurisdiction of the courts and tribunals of Queensland.

The Promoter reserves all rights with respect to such breach. SA, NSW and ACT are excluded from trade promotions due to permit restrictions.

4.3 The Promoter may draw additional reserve Entry Winners in the Draw and record them in order (“Reserve Winner”).

4.4 In the event that:
1. a Winner is deemed ineligible for any reason;
2. after the Promoter makes reasonable efforts, the Winner cannot be identified; or
3. where a Winner forfeits a Prize under Clause 3.1, the Prize may be awarded to the Reserve Winner.
